Terms of Use

Effective Date: February 18, 2026

1. Introduction & Acceptance

These Terms of Use (“Terms”) govern your access to and use of Medcan’s website, the myMedcan application, and any products or services purchased from Medcan Health Management Inc. (“Medcan”, “we” or “us”), whether online, in person, or by phone. By using these services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use our services.

2. Changes to Terms

  • Subject to applicable law (which may include those in the Province of Quebec), Medcan may update these Terms to reflect changes in law, services, or practices.
  • Updates will be posted on our website and/or myMedcan, with the effective date indicated.
  • Continued use after changes are posted means you accept the revised Terms.

3. Eligibility, Age of Consent & Dependents

  • You must be the age of majority in your jurisdiction to use Medcan’s services or have a parent/legal guardian agree to these Terms and make purchases on your behalf.
  • If you are under the age of majority, a parent or legal guardian must contract for and consent to services and purchases for you.
  • You may register dependents for whom you have legal authority (such as minor children or individuals for whom you hold power of attorney) and purchase Medcan services on their behalf. You are responsible for ensuring that all information provided for dependents is accurate and that you have the legal right to make healthcare decisions for them.
  • Certain services may have additional age or eligibility requirements, which will be communicated at the time of booking or registration.

4. Scope of Health Services

Medcan is primarily a provider of in-person primary and preventative health and wellness services at our clinic locations. Our offerings include:

  • Medical consultations and assessments
  • Preventive care and wellness programs
  • Diagnostic and screening tests, and laboratory services
  • Health-related products and services

Virtual Services:
Medcan may offer virtual services (such as telehealth consultations or online appointment booking) as a convenience to clients. These virtual services are incidental and do not replace in-person care. Availability of virtual services may vary and is subject to provider discretion and regulatory requirements.

5. Physicians & Healthcare Providers

  • Only regulated health professionals (physicians, nurse practitioners, etc.) may provide medical services through Medcan.
  • Many of these providers are independent contractors who use Medcan’s platform and clinics to deliver care. Medcan acts as an agent, not as a principal, in facilitating your access to the services they provide.
  • The relationship between you and a provider is a health professional–patient relationship. Providers are responsible for the care they deliver, compliance with professional standards and applicable laws, record-keeping and privacy obligations.
  • Providers may determine that certain services are not appropriate or permitted and may decline to provide care at their discretion.
  • Prescriptions, medical advice, and documentation provided by Medcan’s providers are for your personal use only and must not be shared, altered or used for unauthorized purposes.

6. Third-Party Services

  • Medcan may facilitate services through third parties other than health care professionals.  If you use third-party services (e.g., prescription delivery), you will be contracting directly with those third parties, not Medcan, and those third parties will be liable for any acts or omissions.

7. Intellectual Property

  • All content, trademarks, logos, graphics, software, and other materials available through Medcan’s website, the myMedcan app, and related services (“Medcan Materials”) are the property of Medcan Health Management Inc. or its licensors/licensees and are protected by intellectual property laws.
  • You may not copy, reproduce, modify, publish, transmit, distribute, display, perform, or create derivative works from any Medcan Materials unless you have prior written consent from Medcan.

8. Content

  • The information, materials, and content provided through Medcan’s website, myMedcan app, and related services (“Content”) are for informational purposes. Some Content may be generated by artificial intelligence (AI) technologies. Any Content provided does not constitute medical, legal, or other professional advice.
  • Medcan strives to ensure that Content is up-to-date, but does not guarantee the accuracy, completeness, reliability, or suitability of any Content for your personal circumstances.
  • You are responsible for any information or content you submit, upload, or share through Medcan’s services. You must ensure that your content does not violate any laws, infringe on third-party rights, or contain harmful, offensive, or misleading material.
  • By submitting content to Medcan, you grant Medcan a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, and display such content for the purpose of providing and improving on Medcan’s services.

9. Technology-Related Terms

  • You agree not to misuse Medcan’s website, the myMedcan app, or related services. Prohibited activities include, but are not limited to: Attempting to gain unauthorized access to any part of the services, accounts, or systems. Interfering with or disrupting the operation of the services, servers, or networks. Introducing viruses, malware, or other harmful code. Using automated scripts, bots, or scraping tools to access or collect data from the services. Reverse engineering, decompiling, or disassembling any part of the services or software.
  • Medcan reserves the right to suspend or terminate your access to the services if you violate these technology-related terms or engage in any activity that may harm Medcan, its users, or its systems.
  • Medcan does not guarantee that the services will be uninterrupted, or compatible with all devices or operating systems. You are responsible for ensuring that your device and internet connection are suitable for accessing Medcan’s services.

10. Artificial Intelligence (AI) Disclaimer

Medcan may use artificial intelligence (AI) technologies to support certain features or services within its website, the myMedcan app, or related platforms. AI should not be relied upon as professional medical advice or as a substitute for consultation with qualified healthcare providers.

11. Privacy & Security

Medcan respects your right to the privacy of your personal information.

  • Please review our https://medcan.com/clinic-privacy-policies/ for details on how we collect, use, disclose and otherwise manage any of your personal information.
  • Medcan strives to keep your personal information as secure as possible, and will use administrative, technical and physical protection measures designed to prevent the loss, alteration and unauthorized access to or processing of your data. The security measures we use are industry standard; however, no security measure is guaranteed to be 100% secure.
  • You can help to protect your own data by taking measures such as strong password practices, never reusing passwords across websites, avoiding clicking on malicious emails or links, and ensuring that you have up-to-date antivirus software. You can also keep your data current by providing us with up-to-date contact and payment information.

12. Booking, Purchases & Payments

  • Appointments: When you find a service that suits your needs and schedule, you may request an appointment in person, by phone, or via myMedcan. If Medcan confirms your appointment request, you will receive a notification that your appointment has been accepted and scheduled. Medcan cannot guarantee that every appointment request will be accepted. There may be various reasons why your request is not approved, and Medcan is not obligated to accept all requests. Even after an appointment is confirmed, unexpected circumstances may require Medcan to cancel it. You acknowledge that Medcan reserves the right to cancel your appointment at any time before it takes place.
  • Purchases: Payment is accepted by major credit/debit cards. Prices are quoted in Canadian dollars. The prices displayed do not include applicable taxes. Prices quoted or listed on myMedcan or the Medcan websites are for informational purposes only and may be changed by Medcan at its own discretion without notice.
  • Medcan Dollars: Medcan may provide Medcan Dollars as service credits in connection with certain membership tiers, promotional offers, referral programs, or other engagement initiatives. Medcan Dollars have no cash value, are non-transferable, and may only be applied toward eligible Medcan services. They are not gift cards, loyalty points, or reward points, and they expire on the date specified by Medcan, after which any unused Medcan Dollars will be forfeited. Errors:
Although we strive to maintain an error-free site, we cannot guarantee that all Content, including service pricing, is completely accurate or up to date. If a pricing error is identified, we will update our systems and the corrected price will apply to your purchase. Medcan reserves the right to revoke any stated price, correct errors, inaccuracies, or omissions (even after a purchase has been made), and to cancel, terminate, or decline to process orders (including accepted orders) if the price or other important information is found to be incorrect.

  • Pre-authorization: For certain services, your credit card may be pre-authorized for the estimated amount at check-in.
  • Refunds: If a service becomes unavailable before provision, you will be refunded as described in the specific service terms.

13. Cancellation & Termination

  • User Cancellation: With the exception of certain services, you are entitled to cancel your appointment. If you choose to cancel or reschedule your appointment and do not do so within the time frame specified for your purchased service, a cancellation or rescheduling fee will apply. The specific terms, including any applicable time periods and fees, will be provided to you before you book your Medcan appointment and will also be included in your appointment confirmation email.
  • Medcan Termination: Medcan may terminate your access or membership for overdue payments, breach of these Terms, or violation of Client Rights and Responsibilities, subject to notice requirements.

14. Disclaimers & Limitations

Some jurisdictions, which may include the Province of Quebec, may not allow the exclusion or limitation of certain damages, or on implied warranties. In those jurisdictions, the exclusions and/or limitations below may not apply to you.

  • No Guarantee of Results: As with any service, no results can be guaranteed or assured. Providers may determine that services are not appropriate or permitted and may decline to provide care at their discretion.
  • No Emergency Care: Medcan’s services are not intended for emergency or urgent care. If you believe you are experiencing an emergency, call 911 or seek immediate in-person care.
  • No Replacement for Primary Care: Medcan’s services do not replace your relationship with your primary care provider, unless you are a member of Medcan for primary care services. You are responsible for informing your primary care provider of any care received through Medcan.
  • Risks of Virtual Services: There are risks unique to virtual care, including limitations in the transmission of information, technology failures, and privacy risks. Medcan strives to mitigate these risks but cannot guarantee uninterrupted or error-free service.
  • Limitation of Liability: Services are provided “as is” without warranties of any kind. Medcan’s liability is limited to the amount paid by you for services in the twelve (12) months prior to the event giving rise to liability.
  • Indemnity: You agree to indemnify Medcan and its affiliates against any losses or claims arising from your use of services or breach of these Terms.

15. Governing Law & Exclusive Jurisdiction

All aspects of Medcan’s services and the relationship between you and Medcan are deemed to have occurred in the Province of Ontario and are governed by and in accordance with Ontario laws and the laws of Canada applicable therein (excluding conflict of laws rules).  The Courts of Ontario have exclusive jurisdiction over any complaint, claim, or proceeding arising from or related to those services or the relationship between you and Medcan.

16. Force Majeure

Medcan will not be liable for any loss or damage arising from any event beyond its reasonable control, including, but not limited to, flood, extraordinary weather conditions, earthquake, or other act of God, pandemic, fire, war, insurrection, riot, civil unrest, labour dispute, accident, action of government, communications, power failure, or equipment or software malfunction.

17. Entire Agreement, Severability and Assignment

If any part of these Terms is found to be invalid or unenforceable, that part will be removed, and the rest will remain fully effective.

We can transfer or assign our rights and obligations under these Terms at any time, including as part of a merger, acquisition, or sale of our business. These Terms apply to and benefit both you and us, as well as any permitted successors and assigns.
